Greatcontent provides enterprises and individuals with an e-market place for web content. In other words, it serves as a platform for all kinds of text orders for web pages. The text writers can use the platform to obtain and process the orders. Based on what the client wants, the text will be written by an authorised individual – either a writer or another service offered by the platform – and will be submitted to the client for approval. If the client decides to accept the proposed text, he then becomes the sole beneficiary of the exclusive right to use it and to decide on how the content shall be put to use (e.g. HTML, PDF or printed). The client is not obliged, however, to publish the content.
1. Field of application
1.1. The delivery of the orders, the services, the offers and the contract between greatcontent and the writer will only be presented in the Terms and Conditions.
1.2. Complementary agreements, changes or anything added to the Terms and Conditions should be presented in a written form, unless greatcontent and the client agree otherwise.
2. Definitions of the terms used
In the Terms and Conditions and all previous contracts between the clients and greatcontent, the terms which are used are defined in the following manner:
Enterprise or individual who places an order on the greatcontent platform in the form of an “Open Order”, a “Group Order” or a “Direct Order”.
Individuals or enterprises who are authorised to obtain and process a text order or any other order in the form of an “Open Order” a “Group Order” or a “Direct Order”, following the instructions presented by the client.
A network, used by the enterprise greatcontent AG, which acts as an intermediate between the client and the writer, offering them both technical and personal support. In addition, greatcontent, acting as a services agency, also offers all other services needed. The legal framework needed to implement these services will be found in a separate contract between the client and greatcontent.
2.4 Other types of content
Photos, videos and presentations are not considered to be media content which can be used on websites.
2.5 Open Order
Text order or order for another type of content which will be placed on the platform by the client and which will be available to writers with the same or a higher level than the selected one.
2.6 Group Order
Text order or order for another type of content which will be placed on the platform by the client and which will only be available to a specific group of writers.
2.7 Direct Order
Text order or order for another type of content which will be placed on the platform by the client and which will be directly addressed to one particular writer. These orders will only be available to the selected writer.
2.8 The following deadlines are used on the greatcontent platform:
Deadline to process an order
The time frame for a writer to complete an order is counted in full hours. The timeframe starts from the moment the writer accepts an order. Alternatively, the client can arrange a deadline to suit his or her own needs. If the writer is unable to submit the order to meet the deadline, this order will be lost to the writer. If it were an Open Order, it will be available for all other writers and if it were a Group Order, it will then be available to all other group members.
Deadline for accepting a Direct Order
A writer has three days (72 hours) to accept a Direct Order which the client has specifically addressed to them. After this deadline, the client ought to submit the order to somebody else. The client can cancel an untaken direct order at any time. The client cannot cancel the direct order if already taken by the writer.
Deadline to accept a text
The client has three days (72 hours) to accept a text or another type of content which he has received. If the client requests that the text must be checked, and given that this request is justified, the writer will be automatically informed by the system. After this deadline, the order will be automatically accepted by the greatcontent system and the total amount shall be debited from the client’s account. Clients can reject an order only in exceptional cases. A written justification will always be necessary when rejecting an order.
Deadline to revise a text
When a client requests that a text must be revised, the writer then has one day (24 hours) or two days (48 hours) – starting from the time the request is issued – to make the desired changes to the text. If the corrections are not made in the given timeframe (one day, 24 hours, two days, 48 hours) the order will be taken away from the writer, who will not get paid for it. The order will then be once again available for all other writers (Open Order) or for all other group members (Group Order).
Deadline to correct detected plagiarism
In cases where the greatcontent platform technology detects copied fragments from other internet sources or from the writer’s previous texts, a request for revision will be immediately sent to the writer. The writer then has 2 hours to change the text and remove all plagiarised parts. If the detected plagiarism is a result of a citation, long names, text formatting or the instructions in the client’s own briefing, the writer may still submit the text to the client. The client may request a rejection for a plagiarised text submission if she or he disagrees and does see the detected parts as a real case of plagiarism.
Only working days will be taken into account. Saturdays, Sundays and bank holidays such as the 25th of December and the 1st of January will not be considered when meeting deadlines.
3. Registration at greatcontent
3.1. When opening an account at greatcontent, the writer commits to having read the Terms and Conditions.
3.2. The writer is responsible, for the accuracy of the personal information which he or she provides. The writer should keep his or her personal data updated and is not authorised to create additional accounts with different personal data.
4. Offers and Contracts
4.1. A contract between greatcontent and the writer begins when the writer opens an account at greatcontent.
4.2. A contract between the client and the writer concludes when the writer accepts a text order or any other type of order (Open Order, Group Order or Direct order) from the client.
4.3. The writer is contracted to process an order and to meet the deadlines which have been established. The order will be placed and described by the client via the greatcontent user interface. All supplementary conditions which have been explicitly approved and authorised by greatcontent shall be added to the contract. Any further conditions have to be added through the greatcontent server.
4.4. In addition, both parties (clients and writers) are contracted to accept the timeframes and deadlines mentioned above and a failure to comply with them will result in the consequences outlined in Article 2.8.
5. Writers' obligations regarding the client and greatcontent
5.1 Texts or other content which have been processed by the writer shall be submitted to the client by using the greatcontent user
5.2 Texts or other content created by the writer should be original (unless agreed otherwise) and should follow the criteria below:
i) The content should respect the instructions and all other specific elements which the client has provided in his briefing.
ii) Texts should be written solely by the writer. Texts may never be copied -neither fully nor partially- from another source and should therefore be copyright free. Greatcontent will not be responsible if the texts submitted by writers contain any of the following:
- Incorrect or inaccurate content.
- Violation of intellectual property or any other property rights
- Deliberate dishonesty - plagiarism
5.3 Once the text has been paid for, the writer passes the exclusive rights of the given content to the client. The client decides when and in what media form the content obtained through the greatcontent platform will be published.
It is also possible for the client to use the content he or she has purchased as he or she desires. That is to say, it can be modified, changed or published as many times as the client needs. The writer also agrees to grant the client all rights over the provided content. The client has of course no obligation to use or publish the purchased content, if he or she does not wish to.
5.4 The client can request a text revision he or she has received from the writer. The revision requests should be formulated as clearly as possible, enabling the writer to make corrections quickly and efficiently. It is compulsory for the writer to make these corrections, as this undertaking is included when accepting an order. The request for a text revision will only be made on the basis that the writer has failed to follow the established briefing. The client is not allowed to modify the already established instructions.
The writer then has two days to correct the text or any other type of content and submit it to the client. If the writer does not meet the deadline, the order will then be made available to all other writers (Open Order) or all group members (Group Order). A client will only be able to ask for corrections three times. If the text corresponds to the guidelines established when placing the order, the client is obliged to accept the text.
If the client decides to reject an order, a written justification will have to explain this decision. In this case, greatcontent will be responsible for rereading the text on the one hand, the original description on the other, and communicate with both the client and the writer, in order to come to an objective and impartial conclusion. If the justification for rejecting a text is non-existent or not sufficiently detailed, the rejection will not be considered and the text will be automatically accepted. The total amount of the order will be debited from the client and transferred to the writer.
5.5 The writer does not have the right to sidestep the greatcontent system and directly offer texts to clients. Any attempt to do so will be pursued and will lead to a €1000 fine and permanent exclusion from the greatcontent platform.
5.6 It is strictly forbidden for the writer to use the internal messaging system for issues which are not associated with processing an order. In addition, writers are also forbidden to use the messaging system for spamming (unauthorised publicity). The use of inappropriate language is also prohibited. If greatcontent receives a complaint from the client regarding the use of the messaging system by the writer, greatcontent has the right to intervene and check the behaviour of the latter. If this behaviour is not acceptable, the writer shall immediately be suspended.
5.7 The writer agrees to respect the confidentiality of the services delivered on the greatcontent platform, such as information about the identity of clients.
5.8 The writer has three days to accept a Direct Order, which will have been directly addressed to the latter by the client. If the writer does not meet the deadline, it will be taken away and sent back to the client.
6. Managing quality and control
6.1 When submitting orders, the writer agrees to quality checks. After registering, the writer commits to submit one or more evaluation texts written by him or her and to be used exclusively as a sample. Greatcontent has the right to evaluate and classify a writer in terms of which tariff will be applicable to his or her work, based on the sample text. Every order processed and successfully accepted by the client shall then be remunerated according to the tariff level established.
6.2 Greatcontent retains the right to control, examine, improve or reject any of the clients' orders or any of the writers' work which are placed and processed on the greatcontent platform. This includes the verification of descriptions of orders submitted by the clients to the writers, as well as the communication between writer and client, with the aim of ensuring that the platform is functional and that the texts are achieving the clients expectations. Greatcontent will also check the content submitted by the writers, ensuring they meet the platform's demands. As a result of the on-going control of the quality level of the writers, greatcontent ensures that the writers shall be remunerated according to their level, and that the clients will receive exactly the quality they requested. The client cannot request a member of the greatcontent staff to check on an order. Greatcontent is in no way responsible for the content which has been submitted, nor for the evaluation or the results which have been obtained.
6.3 If the work which has been presented by the writers contains content from third parties (even if it is only partial) or any other property rights violation, the work will neither be evaluated nor examined by greatcontent. Greatcontent does not take responsibility for this kind of content.
7.1 The writer will receive remuneration from the client when the latter has accepted the text/content. This may include a bonus payment, which has nothing to do with the price established by greatcontent or by the writer. This does not represent the right to a supplementary payment.
7.2 The payment will be made via PayPal or Skrill.
7.3 Open Orders are remunerated according to quality level. The total amount of the remuneration is available on www.greatcontent.co.uk.
7.4 The remuneration for Group Orders is higher than that for Open Orders. Please see www.greatcontent.co.uk for the price list.
7.5 Remuneration for Direct Orders will be determined by the individual price the writer has stated on his profile.
7.6 The price for the orders is given in pounds and the orders for photographs will generally be in pence or there may be a total number of pounds for a specific amount of words.
8. Means of payment
8.1 The payments will be processed by greatcontent and the writer's transaction account will be credited accordingly. No interest is paid on any money in the transaction account. Only when the total amount in the transaction account is over £25 can the writer request to be paid.
8.2 The payment shall be processed every two weeks via PayPal or Skrill.
8.3 Payments can be requested multiple times in any one month and will be processed every two weeks. Payment fees of PayPal (PayPal fee depends on country of residence) and Skrill (1%) will be deducted from the account balance after the payment has been made.
9. Account and duration of contract/ realisation of contract
9.1 The writer's account on greatcontent is indefinite.
9.2 The account can be cancelled by the writer at any time 14 days after the account has been created. The cancelation of the account will only be valid when requested via e-mail, letter or fax.
9.3 Greatcontent has the right to deactivate or cancel the account if the writer has not processed any orders in over 12 months.
9.4 Greatcontent and the writer have the exclusive right to cancel an account. Should the writer violate the Terms and Conditions, particularly those stated in Article 5, Greatcontent has the right to cancel the account, suspend the orders and ban the writer from the platform.
9.5 If the writer wants to close his or her greatcontent account this action must be discussed with the greatcontent team beforehand.
9.6 If the account balance is less than £10 when a writer closes his or her account, the writer will not be remunerated.
10.1 greatcontent is only liable if greatcontent or one of its directors or employees can be attributed to intent or gross negligence. Responsibility for the delay remains unaffected.
10.2 The extent to which liability is excluded also applies to officials, managers or employees of greatcontent.
To protect your confidentiality is essential for us. Therefore, the fact that we respect the legal requirements to protect certain data goes without saying. However, it is equally important that you are well aware of how we store your data and what we do with it. You will find this explained below.
What are personal details?
Personal details refer to the data which can be used to reveal your identity. This includes your name, address, e-mail address and telephone number. Information such as the number of people who visit your profile is not directly related to your personal identity, therefore it is not included. Ultimately, you are able to use our platform without having to reveal your personal details.
Where are the personal details stored?
We will not request your name or other personal details if we are answering your questions or if you are dealing with an order. We will need these details if you want to access specific information or our website’s offers. These personal details are very well protected on one of our servers in Germany. Personal details directly linked to your identity will not be given to us unless you have specifically decided to provide us with that information.
Will the information be passed on to third parties?
Your personal information will always stay within our company and will never be released to third parties without your consent. Thank you for placing your trust in us to keep your information protected.
Collection of demographic data
Due to technical matters, certain information is automatically taken from our website’s users, but they are never associated to your identity. This information is normally related to the internet navigator, websites which have been recently accessed and the amount of time they were accessed for. In addition, every time you visit our website, certain data will be kept for security reasons. This data includes the IP address and the time and data of every page accessed. We guarantee that no connection is made using your personal information or data. Greatcontent retains the right to analyse anonymous data. In return, we offer our visitors personalised and adapted content. By separating demographic and personal information, your private sphere is constantly protected.
Use of "cookies"
When you visit our website, certain information in the form of so-called "cookies" is stored on your computer. "Cookies" are small files which allow a website to store information on a user’s machine and then retrieve it. We do not use permanent cookies, but only the so-called "cookies-session", which are automatically deleted when you leave our website. These cookies allow us, for instance, to identify the content which is more interesting for our users, thus helping to create a more efficient platform. However, you do always have the option of modifying the settings on your navigator and blocking the cookies if you wish. According to the chosen setting, the navigator then decides whether cookies will be stored on your computer or not. You can, of course, see all the content on our website without using cookies.

12. In case of changes
Greatcontent should inform the writer about any changes made to the Terms and Conditions. The new conditions will be enforced two weeks after they have been announced unless otherwise stated by the writer. In the case of an objection, the latter will only be valid when written on paper and if greatcontent receive this one week after the changes have been announced.
13. Jurisdiction, applicable law and independant clauses.
13.1 German law is applicable. The language this contract has been written in is English. German law shall be applied if and when needed.
13.2 Where legally possible, competent jurisdiction is applicable to trading partners in Berlin, Germany.
13.3 The writer should put forward any explanation via email.
13.4 If a condition becomes invalid, this will not affect the validity of the remaining dispositions.
